OpenAI says Elon Musk’s lawsuit claims ‘incoherent’

OpenAI said in court filings as a defendant in Elon Musk’s lawsuit that “there is no founding agreement and no agreement has been entered into with Musk.” Of course, we’re talking about Musk’s lawsuit against OpenAI, which accuses OpenAI of infringement losing its nonprofit status and violating the founding agreement, which pledged that the organization would never operate for profit and release its artificial intelligence publicly. The company said the billionaire’s claims were based on “complex and often incoherent factual premises.” It calls the founding agreement “a fictitious story concocted by Musk to gain unearned access to the fruits of a business he initially backed, then abandoned, and then succeeded without him.”

If the case proceeds to an investigation, there is evidence that Musk supports OpenAI’s transition to a for-profit structure “controlled by Musk himself,” OpenAI continued. Furthermore, the billionaire allegedly stopped supporting the project when his ideas were not followed. The statement echoes a blog post the company made earlier this month, which published emails purportedly between Musk and Musk while he was still involved in the organization. According to these communications, Musk was aware of and in favor of turning OpenAI into a for-profit entity. He even wanted to take full control of it as CEO and own a majority stake. Musk also agreed with the proposal to affiliate the organization with Tesla so the automaker could provide funding. Ultimately, the two sides failed to reach an agreement, and Musk ended his involvement.

“Seeing the remarkable technological progress OpenAI has made, Musk now hopes he can be successful, too,” OpenAI wrote in its filing. “Musk claims to be suing for humanity, and the truth is — even from Musk’s contradictory It can also be seen in his plea that he filed the lawsuit to further his business interests.”

Musk launched his own artificial intelligence company, xAI, last year with the lofty goal of understanding “the true nature of the universe.” Days after OpenAI published a blog post claiming that Musk knew he never intended to open source his technology, the billionaire announced that xAI will open source its Grok chatbot. While this is most likely a dig at OpenAI, open source Grok also gets the company’s feedback from the developer community, which xAI can then use to improve its technology.
