Court records show that Apple has appealed the International Trade Commission’s decision to ban sales of Watch Series 9 and Watch Ultra 2 models in the United States. In addition, the company has requested an emergency suspension of the ban for at least two weeks until a decision is made on redesigned versions of the banned models.
“We strongly disagree with the USITC’s decision and the resulting exclusion order and are taking every step to return Apple Watch Series 9 and Apple Watch Ultra 2 to U.S. customers as quickly as possible,” Apple said in a statement. Apple said these models were the most popular, but they were banned after the ITC found that Apple infringed on health technology company Masimo’s blood oxygen saturation technology patent.
In today’s filing, Apple’s lawyers claimed that the $3 trillion company “will suffer irreparable harm” if the models remain removed from shelves during the legal proceedings. According to the document, U.S. Customs and Border Protection’s Exclusion Order Enforcement Division plans to make a decision on the redesigned version of the watch model on January 13, 2023. “At the very least, the court should give Customs a long enough reprieve to make this decision,” the company said.
